Please read these terms and conditions carefully before using Pirate Mobile's eSim services. By using our services, you agree to comply with and be bound by these terms and conditions.

ACCEPTANCE OF TERMS

By purchasing and using Pirate Mobile eSims, you acknowledge and agree to the terms and conditions outlined herein. If you do not agree with any part of these terms and conditions, please refrain from using our services.

DESCRIPTION OF SERVICES

2.1. eSIM SALES

Pirate Mobile sells prepaid eSims that provide mobile data services to customers. The eSims can be purchased through our website or designated sales channels.

2.2. REGISTRATION AND USAGE

To use Pirate Mobile eSims, customers must register on our website or designated platform, providing accurate and up-to-date information. The customer is responsible for maintaining the confidentiality of their account and password.

You must be at least 16 years of age to use the Services. By using the Services and by agreeing to this Agreement you warrant and represent that you are at least 16 years of age or have parental consent to use these services.

The service provided by the Application is not intended for use by any person or entity in any jurisdiction or country where such use would be contrary to law or regulation. Accordingly, those persons who choose to access the Application from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

2.3. DEVICE COMPATIBILITY

Customers must ensure that their devices are compatible with eSims and are network-unlocked. Pirate Mobile provides a list of compatible devices on our website, but it is the customer's responsibility to verify compatibility before making a purchase.

PAYMENT AND CHARGES

3.1. PAYMENT METHODS

Payments for Pirate Mobile eSims can be made using accepted payment methods displayed on our website, including credit cards, online payment gateways, or any other approved payment options.

3.2. CHARGES FOR USE

The charges for using Pirate Mobile eSims will be clearly stated during the purchasing process. All charges are inclusive of applicable taxes unless otherwise specified.

DELIVERY AND ACTIVATION

4.1. DELIVERY

Upon completing the purchase, customers will receive a QR code or activation instructions via email. It is the customer's responsibility to follow the provided instructions to activate the eSim on their device.

4.2. ACTIVATION RESPONSIBILITY

Customers are responsible for activating the eSim according to the provided instructions. Pirate Mobile is not liable for any activation issues arising from customer errors or device incompatibility.

REFUND AND CANCELLATION POLICY

We want you to be completely satisfied with your purchase. If you have any issues with your order, please contact our customer service team at info@piratemobile.gg and we will do our best to resolve the issue.

 

5.1 Right of Withdrawal

As a consumer in the European Union, you have the right to withdraw from the purchase contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g.  email). 

5.2 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You must return the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

5.3 Exceptions to Right of Withdrawal

The right of withdrawal does not apply to the following kind of contracts:

1. Contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized.

2. Contracts for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

3. Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.

 

LIMITATION OF LIABILITY

Pirate Mobile shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our eSim services. We are not responsible for any loss, damage, or unauthorized access to customer devices or data.

MODIFICATION OF SERVICES

Pirate Mobile reserves the right to modify or discontinue any part of the eSim services, including pricing, features, or availability, at any time without prior notice. Such modifications will be communicated to customers through appropriate channels.

PRIVACY AND DATA PROTECTION

Use of Intellectual Property

11.3. Pirate Mobile grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our eSim services for personal and non-commercial purposes, solely in accordance with these terms and conditions.

11.4 You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or materials obtained from our eSim services without the prior written consent of Pirate Mobile.

11.5 "Pirate Mobile" and all related logos, product and service names, designs, and slogans are trademarks of Pirate Mobile or its affiliates. You may not use these trademarks without the prior written permission of Pirate Mobile.

b. Sufficient information to identify the allegedly infringing content or materials;

d. A statement by you, made under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

If any provision of these terms and conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these terms and conditions, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by applicable law. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intent of the original provision.

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Pirate Mobile operates.
